wow. You remind me of one of my ex-wives. Often wrong but never in doubt. The constitution is about 14 pages long, read it sometime. But the section on impeachment is one sentence and leaves no room for your interpretation:

The House of Representatives shall chuse their Speaker and other Officers; and shall have the sole Power of Impeachment.

End of story. And no, I didn't misspell chuse. The house voted on December 18 to impeach. Done. The senate can (and likely will) have a "trial" deciding whether or not to remove him from office, but the impeachment is done.

Clinton was impeached by the House of Representatives and acquitted by the Senate, as Trump is likely to be, but he was indeed, impeached, as Trump and Andrew Johnson have been:

"On December 19, 1998, Clinton became the second American president to be impeached (the first being Andrew Johnson, who was impeached in 1868), when the House formally adopted articles of impeachment and forwarded them to the United States Senate for adjudication.[a] A trial in the Senate began in January 1999, with Chief Justice William Rehnquist presiding. On February 12, Clinton was acquitted on both counts as neither received the necessary two-thirds majority vote of the senators present for conviction and removal from office—in this instance 67. On Article One, 45 senators voted to convict while 55 voted for acquittal. "

A two-thirds majority is required in the senate for a guilty finding. Clinton was NOT found guilty by the senate on either charge.

Putting it as simply as I can you are wrong. Totally, completely, provably, constitutionally, wrong. You couldn't find a two-bit ambulance-chasing lawyer in the backwoods of Oklahoma to agree with you.

This thread (content and emotion) is a decent snapshot of where we are at.  It is a stark divide and it is getting worse.

Example.  The other day we are watching the news and we see Noah Feldman, smart guy, Harvard, yada, show up and say, “technically speaking, the president still hasn’t been impeached.”  Ughhh! Well, you knew someone was going to.  But, this is one of the 3 guys that testified last month in favor of impeachment in front of the House.   https://www.nytimes.com/2019/12/20/us/trump-feldman-impeach.html

In the Trump era it typically takes no substantiation to push an untruth.  Don't like a fact, say the opposite.  But in this case, this concoction was handed to them.  What are the chances that this opinion wasn't going to be seized on?   Right, zero.

In effect, it really makes no difference.  The Dems are holding off to apply pressure, prolong the process, and hopefully negotiate a reasonable trial (witnesses, etc).  They will at some point send it to the Senate.  So, even if you were going to take the Feldman view, impeachment is a flick away and entirely in Pelosi's hands.   There is no time limit on when the articles are passed.

Shoot, if the roles were reversed Mitch McConnell would say (Merrick Garland style), "Being so close to an election, the American people should have a chance to choose the Senate that will decide a matter of this importance".  :)

RG,

Feldman is flexing his intellect.  Even if you agree with his contrarian view, though, he is saying that impeachment is complete with transmission to the senate.  He is not saying that the senate has any determining voice in impeachment.  In his reality that lies entirely with Pelosi.

Good one Burchas!

Just back to the original post for a second, in my opinion (as another 58 yr old dude) Obama looks great.

With respect to whether Trump was impeached or not, he clearly was.  Congress simply has not yet brought the charges to the Senate for trial.

The question we should all be asking ourselves is whether would we support a rule that would allow a Grand Jury to publicly hang an indictment over a person, for an indefinite period of time, without affording that individual the ability to defend at trial.

bad, manipulative analogy, bean--you like to slip stuff like this into the mix--this is a constitutionally mandated impeachment--not a court case---not even close to a grand jury with indictment and courtroom trial

no need to analogize and play puzzler--reality is::white house denied the house access to any witnesses or documents in white house control--trump was impeached anyway,  on basis of ample evidence from the few witnesses who spoke out and rejected white house pressure

senate has said it will not engage a reasonably fair senate trial--hell, McConnell has said he'll be working closely with the white house in the design and execution of the trial--to rig it so trump remains in office, and the news cycle moves on

little to do with your weird grand jury story---id welcome a real live senate trial with witnesses and subpoenas and all that normal stuff---ASAP--godspeed!!!

noone wants a credible senate trial delayed--except the white house, for obvious reasons

obama does look great--some suspect he still smokes on the sly, which would be too bad--he is unarguably a solid honorable husband, parent and family man....
