I could see this happening:

Defendant:  "The lifeguard was mistaken.  I wasn't holding a paddle.  I was holding an Armalite AR-10 carbine gas-powered semi-automatic weapon, pumping round after round into colleagues and co-surfers.
Judge:  "Oh, then I take back what I said.  Nothing illegal about those.  Case dismissed."

Fixed.

I could see this happening:

Judge:  "The charge is using a paddle in a surfing area.  That's a serious charge, because it shows wanton disregard for the safety of others.  What's your excuse?"
Defendant:  "The lifeguard was mistaken.  I wasn't holding a paddle.  I was holding an assault rifle."
Judge:  "Oh, then I take back what I said.  Nothing illegal about those.  Case dismissed."
An assault rifle could still be illegal, better make it a spear gun.
It takes a quiver to do that.

Great thinking.  Only thing better would be if you'd been cited and had to go to court:

Judge:  "So these two were paddling in the lineup illegally?"
Lifeguards:  "Well, actually they weren't paddling.  They didn't have paddles."
Judge:  "WTF?"
Lifeguards:  "They didn't have paddles, but they are standup paddlers."
Judge:  "WTF?"
Lifeguards: "They know how to do it."
Judge:  "Knowing how doesn't make it illegal."
Lifeguards:  "They were also on standup paddleboards."
Judge:  "So?  What's the problem.  You said they didn't have their paddles."
Lifeguards:  "Standup paddleboards are a hazard because they are hard to control."
Judge:  "So you identified them by their being out of control?"
Lifeguards:  "No, they blended in."
Judge:  "So you identified them by their large boards?"
Lifeguards:  "No, their boards are similar size to the legal ones."
Judge:  "So you identified them by them being the largest of the similarly-sized boards?"
Lifeguards:  "No, there were lots of larger boards there that were legal.  We called out, 'You know who you are' so they could identify themselves."
Judge:  "But they had no paddles."
Lifeguards:  "No."
Judge:  "How did you know that others in the lineup were not also standup paddlers without their paddles?"
Lifeguards:  "How could they be standup paddlers without paddles?"
Judge:  "You can't ask that.  I already used that question."
Lifeguards:  "WTF?"
Judge:  "I already used that one, too.  I'm tearing up this citation."
Lifeguards:  "But you have to do something.  There has to be consequences."
Judge:  "OK.  Here's what I'll do.  I'm tearing up the citation, but I'm thinking in my head about them having one."
Lifeguards:  "It doesn't count unless you actually do it."
Judge:  "I'm not doing it, but I know how to do it."
Lifeguards:  "Knowing how to do it isn't the same as doing it."
Judge:  "That's not what you said before."
Lifeguards:  "WTF".
Judge:  "Exactly."

I started SUP just to have an alternative to proning when the surf was small but after having so much fun I don't prone anymore. A knee surgery made it REALLY hard to pop up anymore so that was a major factor for SUP also. I'm 61 and I'd imagine as each year goes by that the aging SUP haters will change their tune also.
But a previous poster DOES bring up a good point that I've thought of before. If you can't pop up anymore should you be denied the pleasure of surfing wherever you want? I think that would be a very strong argument.

Abbott and Costello - Who's on first? Great stuff. Maybe the national park service will allow me to put my small sup which is shorter than many logs on the tram this summer. What paddle? Hehe!

Those lifeguards are knuckleheads. We were camping at San Onofre beach over the New Year as guests of friends but unfortunately it was pretty flat and getting smaller. On one of the days after surfing at Church for awhile 2 of us started to paddle towards Lowers catching the knee high waves along the way. Now mind you it was so small there were at most 2 surfers at lowers that day. So as we were screwing around in the small stuff with not a surfer to be seen along comes the white lifeguard jeep. They stop, watch us for a few and then over their speaker we get the "No Sup's allowed here. You need to go back." We were floored, the beach and surf zone was empty and we were being told to leave by some beach Nazi in their jeep. I considered beaching and having a talk with these boneheads about the law, show off my knee brace and ask how the SUP rules comply with the federal ADA laws. But my lazy half won the argument as making a return trip to the OC was not worth the hassle to fight the ticket. But one of these days, if we get another invite to camp, I just may take the leap and have my day in court because the NO SUP rule there is total bullshit.

I've done the same thing and actually paddled in to have a chat. He was all over the place on what is ok and what isn't, solidifying the fact that they really don't have a set policy.

Now you've got me thinking. There are a few paddle holders out there but I need to design one that allows you to surf prone.

I'd love a custom 27" wide longboard shape that has a trough down the middle where I can clip a paddle into it flush with the deck. How annoying could I be catching waves prone with a paddle in the board.

Is there a ticket for proning while carrying a paddle? That's the one I want to see in court.

Heh, Heh, a "convertible".  Paddle into the line up, when the authorities roll in, just clip it down and start proning.  When they leave, stand back up and catch waves!
