Fight the power

Today a buddy and I were surfing Church on the far north end by ourselves, at least 40 yards from the nearest proner. Full disclosure though, we were at least 60 yards north of the "NO SUP" boundary. Mea culpa.
After about an hour we noticed the lifeguard jeep coming down the bluffs, they have been busting chops lately, even when sups have been legal or right on the line.
When we temporarily lost sight of the jeep, and they could not see us, we chucked our paddles out to sea, dropped down and drifted into the line up.  The jeep stopped right in front of us on the beach and we observed a big question mark literally materialize in the sky, hovering above the roof of the jeep, as the guards tried to figure out what happened to us. We each caught a few the old fashioned way and blended right in, my buddy on his 8-2 and me on a 7-8. The six or eight other guys were cool and didn't narc us out.
After about 15 to 20 minutes when the life guards couldn't figure out who to bust on, one of them came on the PA and said, "Stand up paddlers in the line up, you know who you are, you need to move south to Dog Patch - you know who you are."
After this they drove off in frustration and numbing impotence.
We're no heros, oh no. Cesar Chavez, MLK and Rosa Parks didn't hide in the crowd. (Although she did sit down in protest just as we did.) But it did feel good to stick it to the man, fight the power, and win one for a change.

Heck, on a 7.8 and an 8.2, you shoulda just pointed at the 9.6 longboards there, and have them remove those "big", "dangerous", "battleships" from the water.   ;) :P

The guards are just doing their job. For the most part they'd prefer not to have to enforce pointless regulations...

There are a lot of laws out there that are not enforced.  The guards are the ones that choose to wield the power, they don't have to, but they obviously support the law, by their actions.

Exactly.

Peacefull trickery.  You guys where great.  We should start a fund to pay any eventual tickets, support the resistance.

Great thinking.  Only thing better would be if you'd been cited and had to go to court:


Judge:  "So these two were paddling in the lineup illegally?"
Lifeguards:  "Well, actually they weren't paddling.  They didn't have paddles."
Judge:  "WTF?"
Lifeguards:  "They didn't have paddles, but they are standup paddlers."
Judge:  "WTF?"
Lifeguards: "They know how to do it."
Judge:  "Knowing how doesn't make it illegal."
Lifeguards:  "They were also on standup paddleboards."
Judge:  "So?  What's the problem.  You said they didn't have their paddles."
Lifeguards:  "Standup paddleboards are a hazard because they are hard to control."
Judge:  "So you identified them by their being out of control?"
Lifeguards:  "No, they blended in."
Judge:  "So you identified them by their large boards?"
Lifeguards:  "No, their boards are similar size to the legal ones."
Judge:  "So you identified them by them being the largest of the similarly-sized boards?"
Lifeguards:  "No, there were lots of larger boards there that were legal.  We called out, 'You know who you are' so they could identify themselves."
Judge:  "But they had no paddles."
Lifeguards:  "No."
Judge:  "How did you know that others in the lineup were not also standup paddlers without their paddles?"
Lifeguards:  "How could they be standup paddlers without paddles?"
Judge:  "You can't ask that.  I already used that question."
Lifeguards:  "WTF?"
Judge:  "I already used that one, too.  I'm tearing up this citation."
Lifeguards:  "But you have to do something.  There has to be consequences."
Judge:  "OK.  Here's what I'll do.  I'm tearing up the citation, but I'm thinking in my head about them having one."
Lifeguards:  "It doesn't count unless you actually do it."
Judge:  "I'm not doing it, but I know how to do it."
Lifeguards:  "Knowing how to do it isn't the same as doing it."
Judge:  "That's not what you said before."
Lifeguards:  "WTF".
Judge:  "Exactly."

Wait, wait, wait… do you mean you literally chucked SUP paddles (usually worth $150+up) to avoid being told to move down the beach? :o

This could spark a new trend.. Paddle Holders. You could use pipe clips to secure the paddle to the board and use the board as a proner when need be.

I really think the Sup regulation laws around San Clemente will be tested this summer with the growing number of SUP and the increasing skill level and the ensuing use of smaller boards. I SUP'd Old Mans a couple weeks ago at head high and that was a FUN SUP wave! Wouldn't mind doing it all the time with no hassles.

The argument of how dangerous SUP is compared to a beginner on a longboard is losing credibility as a viable argument.

Right on, SW!

Could a surfer with a shoulder injury, file a complaint against the municipality, under the Americans with Disabilities Act?  Doesn't the ADA prohibit discrimination against people with disabilities in public accommodation?

Judge:  "The charge is using a paddle in a surfing area.  That's a serious charge, because it shows wanton disregard for the safety of others.  What's your excuse?"
Defendant:  "The lifeguard was mistaken.  I wasn't holding a paddle.  I was holding an assault rifle."
Judge:  "Oh, then I take back what I said.  Nothing illegal about those.  Case dismissed."
